Conflicto de competencia suscitado entre el Juzgado Primero Civil del Circuito Especializado en Restitución de Tierras de Apartadó y el Juzgado Primero Administrativo Oral del Circuito de Turbo.
Para la Corte resultó obvio entender que el despacho judicial que dejó de observar las reglas relacionadas con la competencia por factor territorial señaladas en el artículo 37 del Decreto 2591 de 1991 fue al del municipio de Turbo.
Consecuentemente decidió remitir el expediente a esta autoridad para que asuma el conocimiento de la solicitud de amparo formulada y adopte la decisión de fondo a que haya lugar, sin más dilación.
